Sometimes a potential client will ask me to provide a list of references, i.e., the names of past clients, for them to contact concerning whether the reference was pleased with my representation and criminal defense services. While I believe there are many names I could provide, I cannot do so because of the important attorney-client privilege that applies--not only during current representation, but also to former representation.

As you can imagine, regardless of what the charge is, but especially with the more socially frowned upon crimes, e.g., Solicitation of Prostitution or sex-related crimes, most people are uncomfortable with sharing that information with their family, friends, co-workers, and even with me as their lawyer--and I have heard and seen a lot! Thus, even if the attorney-client privilege did not prohibit me from sharing the names of former clients, most, if not all, of my former clients would.
